Hi everyone. i have a question. Im soon releasing a game and when i say releasing it i mean selling copys. now i cant use sketchup at all im terrible with it i can only make minor changes to models. because of that i download models of 3d warehouse remix them a bit and put them in my project. to release a game commercialy would this be illegal? i mean there basicly giving away there models so they should expect to see remix versions of there models right?

Commercial games have lots of stuff to cover... To ensure your "safety", you might feel better if you ask the creators of the models for permission... It doesn't hurt... I tell you! I think people are just waiting you to politely ask them for permission... I'm sure they will allow you... Just find a way to communicate with them...

just to clarify: getting permission from modelers does NOT count, as ALL models submitted to 3D Warehouse are the property of.....3D Warehouse! so read the above links, and if unsure - call a lawyer! but one grey area is google models - i'd avoid them at all costs as it's not the kind of company u want knocking at your door!

update: that also includes Geolocated Models made by ANY trimble user [not just by google inc]: '...you shall not use or incorporate such Model in any application, product,....' to check go to window-model info-geo location. wish i understood that when i 1st read it as i have spent hours collecting 600+ models likely 80% geo'd, at least i only exported 10 so far

As i just read this, seeing that i'm using sketchup models in my current project - help.sketchup.com/en/article/3000049I only see an issue if - #1 You try to sell unmodified copy's of downloaded models. #2 You create links to the sketchup models on your own website ( basically trying to recreate your own version of the warehouse ). #3 You publish an article that includes unmodified sketchup models. As i see it, if you download and modify models, the modified parts become your property, the unmodified parts remain the authors property, but you still have the rights to use them, taking into account other limitations and permissions. If you project also includes non sketchup models, you can fully sell your projects without concern. You can NOT sell unmodified models as your own property for profit, unless those models are also included into a collection with modified and or non-warehouse models. So... grab models, make some of your own as well, maybe even modify some of the warehouse models, then include them in your projects and you CAN sell them for profit , wouldn't hurt to credit the author and even as mentioned, ask for permission to use the models before hand.

consider this: 'You may not, and you may not permit anyone else to: remove, obscure or alter any product identification, proprietary, copyright, trademark or other notices contained in the Model or accessed in conjunction with or through the Model;'
-and all geo loc models usually have a locked terrain base, which is a sat img from google earth and has a copyright logo and name of the owner of said img, which exported models include as a 'Google Earth Snapshot' img. these models are often textured using google street photo img's aswell which may have other issues.
but you cannot remove [or obscure under water etc] that logo, and if you include it, it would likely violate laws for the owner of it unless you have permission to display their name. i have seen some commercial games use google sat img's for textures but no doubt they got a license for that, i doubt it's any different for indies.
this means i will be texturing non geo models now which is for the best anyway, pre-textured was way easier but if it's too good to be true it likely is.
if in doubt chuck it out i say.

...oh, and disturbingly i noticed in those FAQ that they have deleted the question: 'can i use in commercial games?' answer was 'probably, if etc, etc...'
so it seems a bit of a grey area even to trimble now.

where does it say that? please quote it from the site e.g:
'notices contained in the Model or accessed in conjunction with or through the Model'
-that includes textures by my interpretation, if you're not sure you can contact the site for an exemption, but i wouldn't waste my time.

further info i found to confirm what i said is in the sketchup pro agreement: '...to use...etc...and create derivative works of the Street View Content as embodied in a model created with the Photo Textures feature (a "Photo Textures Model"). You may not disassociate or separate the Street View Content from the Photo Textures Model.'
